MEMORANDUM OF POINTS AND AUTHORITIES

 

I.          STATEMENT OF FACT

II.        LAW AND ARGUMENT

Arizona Revised Statute §13-4429.B states:

If the victim’s property has been admitted as evidence during a trial or hearing, the court may order its release to the victim if a photograph can be substituted.

The victim’s property, specifically [insert property item(s)] was admitted at [trial/a hearing on [date]] conducted before this court. The victim, hereby, requests that this property be photographed and, thereafter, returned to the victim, pursuant to A.R.S. §13-4429.B. The defendant’s attorney or his/her investigator may be permitted to inspect this property and may independently photograph this property prior to its release. A.R.S. §13-4429.B. The victim asserts that photographing the property will adequately preserve the evidentiary value of the property and not prejudice either party.
